Talent Search Connect Terms and Conditions
Definitions
Add Candidate to Database means a Talent Search Connection Method offered to Advertisers, allowing them to obtain access to a candidate’s resume and contact information, which is automatically uploaded to the Advertiser’s specified job in their Applicant Tracking System.
Advertiser means any Person who places a Job Advertisement on the SEEK Website.
Contracted Advertiser means an Advertiser who purchases a SEEK Contract or an Ad Pack allowing it to place Job Advertisements on the SEEK Website for an agreed fee.
Credit Pack means an allotment of Talent Search Credits for use in Talent Search Connect purchased by an Advertiser in accordance with section ‘B’ below.
Job Advertisement means any type of advertisement for a job vacancy posted on the SEEK Website. Click here to see SEEK’s Job Advertisements.
Message means a Talent Search Connection Method offered to an Advertiser allowing it to send an electronic message to a candidate.
Person includes natural persons, bodies corporate partnerships associations firms governments and governmental authorities and agencies.
SEEK means SEEK Limited ACN 080 075 314.
SEEK Profile means a profile of a candidate that provides personal information about that candidate that may include (amongst other things) the candidate’s name and work history and is available to Advertisers via Talent Search Connect.
SEEK Website (and “Site”) means the SEEK New Zealand website located at url: https://www.seek.co.nz/, and all co branded versions of that website.
Send Job means a Talent Search Connection Method offered to an Advertiser in accordance with clause 4 below allowing it to invite a candidate to apply for a particular Job Advertisement placed by that Advertiser by electronically sending that Job Advertisement to that candidate.
Talent Search Connect means the Talent Search Connect product offered by SEEK which Advertisers may elect to purchase, allowing them to search for and access SEEK Profiles.
Talent Search Connection Methods means the Add Candidate to Database, Message, and Send Job facilities which can be accessed by Advertisers with Talent Search Credits in accordance with clause 4 below.
Talent Search Credits means credits granted to an Advertiser in accordance with the terms below necessary to utilise the Talent Search Connection Methods.
Purchasing Talent Search Connect
Talent Search Connect can be purchased via a SEEK Contract or via a Credit Pack. To determine how you are able to access Talent Search Connect, please contact your SEEK Sales Representative.
Advertisers who purchase Talent Search Connect via a SEEK Contract will be granted and may use Talent Search Credits on the Terms outlined in section ‘A’ below.
Advertisers who purchase Talent Search Connect via a Credit Pack will be granted and may use Talent Search Credits on the Terms outlined in section ‘B’ below.
A. Talent Search Credits purchased via a SEEK Contract
1. For Contracted Advertisers buying access to Talent Search Connect via a SEEK Contract the following rules apply:
a. SEEK will grant Contracted Advertisers who purchase Talent Search Connect the number of Talent Search Credits specified in your SEEK Contract that correlates to your job ad budget.
b. Talent Search Credits relating to your SEEK Contract (including any credits granted as part of a Credit Top up – see below) will:
i. be granted on the start date of the SEEK Contract; and
ii. expire at the end of the Contract Period (as that term is defined in your SEEK Contract).
c. If during the Contract Period your Talent Search Credit balance reduces to 250 (or less), SEEK will automatically grant you the number of credits specified in your SEEK Contract as “Additional Credits” and charge you the fee specified for those credits in your SEEK Contract (Auto-top Up).
d. Auto-top Up may be turned off on request at any point in time during your Contract Period by contacting SEEK.
e. You will not be granted additional credits for any Job Advertisements placed.
2. Any Talent Search Credits not used prior to the expiry date in clause 1.bii will immediately lapse.
B. Talent Search Credits purchased via a Credit Pack
3. For Advertisers buying access to Talent Search Connect via a Credit Pack, the Talent Search Credits will:
a. be granted on the date specified as the start date in the Credit Pack contract provided by SEEK (the “Credit Pack Commencement Date”); and
b. expire on the end date listed in your live SEEK Contract or once all credits are consumed (whichever is sooner).
General Talent Search Connect Terms
4. Subject to the daily limits in clause 15 below, during the period that an Advertiser has access to Talent Search Connect and has valid Talent Search Credits, an Advertiser is entitled to apply their Talent Search Credits towards the use of any of the Talent Search Connection Methods at their ultimate discretion in respect of any candidates who appear in Talent Search Connect.
5. The number of Talent Search Credits required to use each Talent Search Connection Methods is as follows:
a. Send Job – 25 Talent Search Credits
b. Message – 50 Talent Search Credits
c. Access CV – 250 Talent Search Credits
6. When you purchase Talent Search Connect, you will be granted credits as set out in section A or B above and will forfeit all standard Talent Search Credits available to you at that time. While you have Talent Search Connect you will not be granted additional credits for any advertisements placed.
7. Use of all Talent Search Connection Methods by an Advertiser including any access that an Advertiser may gain to a candidate’s SEEK Profile must strictly comply with these terms, the SEEK Advertising Terms of Use and the SEEK Product Terms and Conditions.
8. Notwithstanding clause 4, the Talent Search Connection Methods must only be used for the purposes of a genuine hiring process in respect of an employment opportunity for which you are currently recruiting. If SEEK detects activity in breach of these terms we reserve the right to immediately remove any live Job Advertisements you may have placed, withdraw any Talent Search Credits granted to you, and/or remove access to Talent Search Connect without any obligation to refund unused Talent Search Credits.
9. You acknowledge that you understand that:
a. a standard SEEK Profile is a SEEK Profile where the candidate has consented to releasing their resume; and
b. a limited SEEK Profile is a SEEK Profile where the candidate’s resume cannot be accessed due to the candidate’s allocated privacy settings.
10. When you access a candidate’s resume using the Add Candidate to Database connection method the candidate will receive a notification from SEEK that you have viewed their SEEK Profile and that their resume has been provided to you.
11. When you select to view a candidate’s ATS profile or select to view a candidate’s SEEK Profile, you acknowledge that the candidate will receive a notification from SEEK that you have viewed their SEEK Profile.
12. You agree to at all times deal with any information provided through or accessed from the Site or Talent Search Connect in a manner which abides by all applicable laws of Australia, or of any other relevant jurisdiction (including, without limitation, privacy and copyright laws).
13. You must not use Talent Search Connect or Talent Search Connection Methods for the purposes of soliciting business from candidates and/or promoting products or services you offer other than in relation to a genuine hiring process.
14. Advertisers’ use of the Talent Search Connection Methods will be capped as follows:

Variation of Terms
15. We may vary these Terms at any time. We will provide notice by publishing the varied Terms on the Site and you accept that such publication will constitute sufficient notice.
16. You will be notified of any changes to the Terms which SEEK reasonably believes will be materially detrimental to you (Detrimental Change) 30 days prior to them taking effect (Notice Period).
17. In the event of a proposed Detrimental Change, you may elect to terminate that portion of your agreement with us that relates to Talent Search Connect during the Notice Period by providing at least 5 days’ written notice.
Void or unenforceable terms
18. Any clause within these Terms which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity or enforceability of the remainder of these Terms is not affected.
