Ad Sync Terms of Use

These Ad Sync Terms of Use (Terms) govern your use of our Ad Sync feature and is incorporated into the Advertising Terms of Use and any Commercial Agreement (formerly known as an Advertising Agreement or Sales Agreement) to which you have already agreed.

All defined terms used in the Advertising Terms of Use have the same meaning in these Terms. In the event of any conflict, these Terms prevail.

How Ad Sync works

1. The Ad Sync feature allows you to efficiently and seamlessly post all of your company’s job advertisements on our employment website and apps (Platforms) via a comprehensive job feed (either in XML or Json format) delivered to us directly from you or via your third-party recruitment software provider (RSP).

2. Eligible Job Ads sent to us via your approved job feed will be posted on our Platforms as Branded Basic Ads (for job ads located in Australia and New Zealand) or Branded Ads (for job ads located in Asia) (as defined in our Product Terms and Conditions), unless you have set up, and agreed with us, specific Ad Sync Rules as outlined in clauses 17 to 21 below. An Eligible Job Ad means a job advertisement that was sent to us via your approved job feed and complied with the Ad Sync Rules set out in these Terms (see clauses 17 to 21 for more details).

3. You must ensure that all job advertisements posted on our Platforms are for genuine, legitimate and current employment opportunities and comply with all Applicable Laws.

Access to Ad Sync

4. To integrate and access the Ad Sync feature, you will be required to provide us with all information outlined within the Ad Sync Activation Email (please contact your account manager for the Ad Sync Activation Email) in addition to any other information we may require from time to time. The information that you provide us as set out in the Ad Sync Activation Email will also make up the Ad Sync Rules relevant to your use of the Ad Sync feature (see clauses 17 to 21 for more details).

5. You will provide us with your job feed that complies with the instructions set out in the Ad Sync Activation Email, which will allow you to access our Ad Sync feature. If your job feed is provided by your RSP on your behalf, you remain responsible for all obligations under these Terms.

6. If your job feed contains job advertisements for multiple businesses spread across SEEK account hierarchy, then your job feed should have a field that uniquely identifies each business that each job advertisement belongs to. You must provide us the field value that maps to the specific SEEK account in the Ad Sync Activation Email so that we can appropriately set that up on our Platform. You must also provide a default account in the Ad Sync Activation Email so that in the instance where a job advertisement could not be mapped to any account, it will be posted against the default account. If no default account is provided, these job advertisements will not be published on our Platform.

7. It is your responsibility to ensure that all information provided to us via clauses 4 to 6 above are accurate and remain current throughout your use of the Ad Sync feature. You are also required to ensure that your job feed complies with our security requirements outlined in clauses 25 and 26 below.

8. If any of your job advertisement in your job feed does not comply with the requirements set out in these Terms, we will not be able to post the job advertisement on our Platforms.

9. Once we have approved your proposed job feed for use of our Ad Sync feature, we will commence posting your Eligible Job Ads on our Platforms in accordance with these Terms within 1 business day of receiving your job feed. If you do not see any of your Eligible Job Ad posted on our Platforms after 1 business day, please contact your account manager. For the avoidance of doubt, you are still able to post job advertisements directly on our Platforms or via your RSP without the use of our Ad Sync feature.

10. It is not our responsibility to ensure that the job feed delivered to us and/or job advertisements posted on our Platforms are current or accurate at all times. You agree that you are solely responsible for the content of the job feed and for checking your job advertisements for any errors or inaccuracies as soon as they are placed on our Platforms.

11. If the content of your job feed is incomplete, you agree that we may:

a) infer some information based on your existing information for the purpose of improving candidates’ searches (for example, salary range); and

b) infer and publish appropriate information (including granular location, job category, job ad summary) to appear on an Eligible Job Ad based on your existing information. For clarity, we will not display a salary on an Eligible Job Ad unless you have provided such information in your job feed. We may use generative AI to generate such content. The content that is generated might be inaccurate, incomplete or not suitable for your role and company. Please review and edit such content as soon as they are placed on our Platforms.

12. You understand and agree that we impose character restrictions on certain job ad attributes included within the content of your job feed (including Title, Description, Summary, Bullet Points, Salary Display text). In the event that the information provided in your job feed exceeds the corresponding character limit set on these attributes (see limits below), we will shorten the attributes provided by you to meet our corresponding character limit before publishing the applicable job ad.

a) Job Title has a limit of 80 characters

b) Job Description has a limit of 15,000 characters

c) Job Summary has a limit of 150 characters

d) Bullet Points each have a limit of 80 characters

e) Salary display text has a limit of 50 characters

13. If you plan to update the format of your job feed, please contact your account manager before such change to ensure that the Ad Sync feature continues to operate effectively.

14. Unless an expiry date is provided in your job feed, each Eligible Job Ad remains posted on our Platforms for 30 days from the time of posting (unless removed earlier) (Post Period). If the expiry date provided in your job feed is greater than 30 days, the Eligible Job Ad will expire on its 30th day and will not be refreshed.

15. You can expire an Eligible Job Ad that has been posted on our Platforms prior to the expiry of the Post Period by removing the corresponding job advertisement:

a) from your job feed and the removal will flow through to our Platforms via your job feed within 1 business day;

b) from your career site or on your RSP’s applicant tracking system (ATS), but you must ensure that the removal of that job advertisement be reflected in your job feed too. Such changes will flow through to our Platforms via your job feed within 1 business day; or

c) via SEEK’s Employer site but such removal will not flow through to your career site or your RSP’s ATS, and the corresponding job advertisement will continue to remain on your site or your RSP’s ATS.

16. You can make changes to an Eligible Job Ad that has been posted on our Platforms by:

a) amending the corresponding job advertisement on your job feed and such changes will flow through to our Platforms via your job feed within 1 business day;

b) amending the corresponding job advertisement on your career site or on your RSP’s ATS, but you must ensure that the amendments are reflected in your job feed too. Such changes will flow through to our Platforms via your job feed within 1 business day; or

c) making the changes via the SEEK’s Employer site but such edits will not flow through to your career site or your RSP’s ATS. Please note that once the job advertisement has been edited in the SEEK’s Employer site, any subsequent changes made to that job advertisement on your career site or your RSP’s ATS will not flow through to our Platform via your job feed.

Ad Sync Rules

17. The information that you provide us as set out in the Ad Sync Activation Email and the rules set out in clauses 18, 19 and 20 and will make up your Ad Sync Rules, which will apply to each of your job advertisements sent to us via your approved job feed. Only the primary account holder of your SEEK account is authorised to set up or edit these Ad Sync Rules. These Ad Sync Rules may be agreed with us via your Ad Sync onboarding process or as agreed with your account manager.

18. You may set up specific Ad Sync Rules that control which of your job advertisements within your job feed are posted to our Platforms and how those job advertisements will be treated. Your agreed Ad Sync Rules allow the following:

a) If there is no specific Ad Sync Rules set up for your account, Eligible Job Ads sent to us via your job feed will be posted on our Platforms as Branded Basic Ads (for job ads located in Australia and New Zealand) or Branded Ads (for job ads located in Asia).

You can override SEEK’s default settings by setting up rules that configure to your chosen default job ad type (e.g. Lite (for roles posted in selected Asia markets only), Basic, Branded Basic/Branded, Advanced, Branded Advanced, or Premium ad) for each of your markets. For example, you could set a rule such that all ads in Singapore are posted as Lite ads and Premium ads in Australia.

b) You can set one or more conditions for your job advertisements and each condition can be specific to certain attributes such as on job title keywords, location, and/or salary;

c) Your specified conditions can then be applied to determine which job ad type (e.g. Lite (for roles posted in selected Asia markets only), Basic, Branded Basic/Branded, Advanced, Branded Advanced or Premium ad) is posted on our Platforms for job advertisements that meet the specified conditions (for example, you could set a rule such that all job advertisements with a salary higher than $100,000 be posted as Premium ads);

d) If an Ad Sync Rule has more than one condition, all conditions must be met for that Ad Sync Rule to apply;

e) If you have one or more Ad Sync Rules, the rules will be applied in top-down order when conflicts exist between rules;

f) Any new or modified Ad Sync Rule will only affect future job advertisements, not existing job advertisements that have been posted to our Platforms; and

g) You can exclude a job ad from being posted to our Platforms by adding an exclusion rule or by adding a tag “#s-dni” within the job description of a job advertisement but such job advertisements will still be posted on the website/s of our related bodies corporate, JORA, to increase the exposure of your job advertisement.

19. Your account manager will work with you to agree your Ad Sync Rules. A confirmation email will be sent to you with the agreed Ad Sync Rules that have been configured in accordance with your specifications. You agree that it is your responsibility to check the confirmation email for any errors or inaccuracies of these Ad Sync Rules and to contact your account manager as soon as possible to rectify any errors or inaccuracies. Any modification or rectification will flow through to our Platforms via your job feed within 1 business day.

20. Additional Ad Sync Rules that you cannot amend:

a) There can only be one location provided in the job feed for each Eligible Job Ad. If you wish to post that Eligible Job Ad in multiple locations, you should create duplicates of that job advertisement within your job feed for each location;

b) The job feed must not contain expired jobs or jobs no longer valid. The expired job advertisements should be removed from the job feed entirely as soon as they expire; and

c) You should not include a job advertisement in the job feed if the job advertisement (which was previously posted manually on our Platform) is still a current job advertisement being advertised on our Platform.

21. The primary account holder of your SEEK account may amend your As Sync Rules by contacting your account manager and such changes will flow through to our Platforms via your job feed within 1 business day. Any changes to an Ad Sync Rule will only affect future job advertisements, not existing ones.

Fees and Reporting

22. The fee for each Eligible Job Ad posted on our Platforms via our Ad Sync feature will be charged in accordance with our standard fees and charges for job advertisements as outlined in our Product Terms and Conditions and any Commercial Agreement that you have agreed with us.

23. You acknowledge and understand that the price of an Eligible Job Ad at a point in time may be viewed through our price checker tool: for roles in Australia (https://talent.seek.com.au/account/ad-price-lookup), for roles in New Zealand (https://talent.seek.co.nz/account/ad-price-lookup/preview) for roles in Singapore (https://sg.employer.seek.com/account/ad-price-lookup) and for roles in Hong Kong (https://hk.employer.seek.com/account/ad-price-lookup), and that it is your responsibility to look up the price of each Eligible Job Ad before it is automatically posted through Ad Sync, especially noting that some ad types are variably priced.

Important note: When using Ad Sync, the cost of Eligible Job Ads will not be displayed at the point of posting as ads are automatically posted through your job feed. By agreeing to these Terms, you acknowledge this automated process and accept responsibility for checking prices through the price checker tool if you wish to know the exact price of each Eligible Job Ad before it is posted.

24. Important note: You acknowledge that the automated nature of the Ad Sync feature may result in a significant number of job advertisements being posted to our Platforms, potentially leading to substantial charges. It is your responsibility to continuously monitor your usage and spend. To help you monitor your usage and spend of Eligible Job Ads posted via the Ad Sync feature, you can check the price charged for each Eligible Job Ad via the ‘Analytics’ tab on the SEEK Employer site either by viewing the ad performance report (where you can see the price of an individual job advertisement along with its performance) or by downloading the full ad usage report (which shows the price of all job advertisements that you have posted including Eligible Job Ads). Additionally, a monthly ad usage report will be emailed to you that captures all the job advertisements (including Eligible Job Ads) that you have posted in that month along with price being charged for each of them. For more specific reporting on job advertisements posted via the Ad Sync feature, please contact your account manager.

Security and Support

25. You must ensure that your job feed and your Ad Sync feature access does not introduce any viruses, worms, defects, trojan horses, malware or any other items of a destructive nature to our systems.

26. Your job feed must be configured securely and you must take reasonable steps to ensure that data transmitted over your job feed is protected from misuse, interference, loss, unauthorised access or damage. You must immediately contact us if you become aware of or suspect any security deficiencies, vulnerabilities, intrusions or breaches of your systems that might impact upon the job feed that you are providing to us as part of your access of the Ad Sync feature.

27. In the event of the security issue in respect of your access to the Ad Sync feature, we reserve the right to temporarily or permanently reduce or restrict your access to the Ad Sync feature until the issue has been remediated.

Dispute Resolution

29. If a dispute arises between you and SEEK in relation to these Terms or any engagement made under it, you may promptly provide written notice to SEEK specifying the nature of the dispute (Dispute Notice).

30. SEEK will use reasonable efforts to arrange a discussion with you within 10 business days of the date of the Dispute Notice.

31. You will, acting reasonably and in good faith, seek to resolve the dispute by negotiation.

32. Except in order to seek urgent injunctive relief, you may not commence legal proceedings in relation to a dispute under these Terms unless you and SEEK have been unable to resolve the dispute by negotiation within 20 business days of the date of the dispute notice.

33. Pending resolution of any dispute, you must continue to perform your obligations under these Terms.

General

34. As between the parties, you own all intellectual property rights, title and interest in and to your job feed.

35. You may cancel your access to the Ad Sync feature at any time by providing us with at least 7 days’ notice. You will be required to make payment for all job advertisements that have been posted on our Platform via our Ad Sync feature up until the point that your access to the Ad Sync feature ceases.

36. We may, in our absolute discretion, suspend or cancel your access to the Ad Sync feature if you materially breach these Terms and fail to remedy any such breach within 14 days of receiving notice.

37. We may vary these Terms in accordance with clauses 88-90 of our Advertising Terms of Use.

38. We reserve the right to cease offering the Ad Sync feature by providing you with at least 14 days’ prior notice.
